End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legally binding agreement between you (“Licensee”) and Alba Design Lab (“Licensor”) governing your use of the digital font software and typefaces provided by Alba Design Lab.
By downloading, installing, or using the Fonts, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Fonts.

1. Intellectual Property

The Fonts, including all designs, data, trademarks, and associated intellectual property rights, are the exclusive property of Alba Design Lab and are protected under Australian and international copyright laws.
This Agreement grants you limited rights to use the Fonts and does not transfer ownership.

2. License Grant

2.1 General License

Subject to payment and compliance with this Agreement, Alba Design Lab grants the Licensee a non-exclusive, non-transferable, worldwide license to use the Fonts for the permitted purposes defined at the time of purchase.
Unless otherwise specified, the license is perpetual for the purchased version of the Fonts.

2.2 License Types

Your rights depend on the license(s) purchased. These may include:

(a) Desktop / Print License

Allows installation of the Fonts on a specified number of devices for:

• Print design (e.g., posters, packaging, books)

• Static digital images (e.g., JPG, PNG)

(b) Web License

Allows embedding of the Fonts on a specified domain(s), subject to traffic limits.

c) App License

Allows embedding of the Fonts in mobile apps, software, or games, subject to user limits.

d) Social Media + Digital Ads License

Required for use on Social Media pages and Digital advertisements, subject to traffic limits.

(e) Broadcast / Campaign License

Required for use in advertising campaigns, television, streaming, or large-scale digital distribution.

2.3 Scope and Limits

• Use is limited to the number of users, devices, domains, or impressions specified at purchase

• Each separate use case may require a separate license

• Fonts may not be shared beyond licensed users

2.4 Internal Use and Contractors

You may provide access to employees and contractors strictly for your own projects. You are responsible for ensuring compliance with this Agreement.

2.5 License Upgrades

If your usage exceeds the licensed scope, you must upgrade your license. Continued use beyond licensed limits constitutes a breach.

3. Permitted Uses

You may:

• Use the Fonts in commercial and personal projects within your license scope

• Include Fonts in branding, marketing materials, and creative works

• Provide Fonts temporarily to service providers (e.g., printers), provided they delete them after use

• Create outlines or rasterised versions of text for distribution

4. Restrictions

You must not:

• Share, distribute, or resell the Fonts

• Upload the Fonts to public servers or file-sharing platforms

• Allow access to unlicensed third parties

• Embed Fonts in a way that allows extraction or reuse

• Create or distribute modified versions of the Fonts as standalone products

• Rename or claim authorship of the Fonts

5. Modifications

You may modify outlines for internal use (e.g., logo customisation), but:

• You may not modify the font files themselves for redistribution

• You may not create a new typeface based on the Fonts

• Alba Design Lab is not responsible for issues arising from modifications

6. Fees and Payment

6.1 Pricing

All prices are listed in Australian Dollars (AUD) unless otherwise stated.

6.2 Payment Terms

Payment must be made in full prior to access.

6.3 Refunds

To the extent permitted under Australian Consumer Law, all sales are final. Refunds are not provided for change of mind.

7. Australian Consumer Law

Nothing in this Agreement excludes, restricts, or modifies any rights you may have under the Australian Consumer Law, including guarantees that cannot be excluded.
Where liability cannot be excluded, it is limited to the replacement of the Fonts or the cost of re-supplying them.

8. Support and Updates

8.1 Support

Limited email support may be provided for a reasonable period after purchase.

8.2 Updates

Alba Design Lab may update or improve the Fonts but is not obligated to provide updates.

9. Termination

This Agreement may be terminated if you breach its terms. Upon termination, you must cease all use of the Fonts and delete all copies.

10. Liability

To the maximum extent permitted by law, Alba Design Lab is not liable for:

• Indirect or consequential loss

• Loss of profits, revenue, or data

• Business interruption

  Fonts are provided “as is” for standard design use.

11. General Provisions

11.1 Entire Agreement

This Agreement constitutes the entire agreement between the parties.

11.2 Amendments

Alba Design Lab may update this Agreement at any time. The version at purchase applies to your license.

11.3 Governing Law

This Agreement is governed by the laws of Australia.
